Agreement to These Terms

By accessing this website, requesting a quote, or engaging GoTech.us for any service, you agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use of this website and do not submit any service requests. Individual service engagements are governed by a separate written Service Agreement that supplements these terms.

1. Services

GoTech.us provides managed IT support, AI-powered firewall monitoring and management, cybersecurity assessments, penetration testing, and software development services to businesses and organizations. The specific scope, deliverables, pricing, and service level expectations for each engagement are defined in a written Service Agreement executed between GoTech.us and the client prior to service commencement.

Services described on this website are provided for informational purposes. Availability of any specific service is subject to mutual agreement and geographic feasibility.

2. Acceptable Use

You agree not to use this website or GoTech.us services to:

  • Violate any applicable local, state, federal, or international law or regulation
  • Transmit or upload malicious software, malware, or any code designed to disrupt, damage, or gain unauthorized access to systems
  • Conduct, facilitate, or attempt unauthorized access to any computer system or network
  • Circumvent or attempt to circumvent any security controls, monitoring systems, or authentication mechanisms
  • Transmit unsolicited commercial communications or engage in phishing
  • Submit false or misleading information in quote requests or service forms
  • Reverse engineer, decompile, or otherwise attempt to extract proprietary methods or source code from any GoTech.us-delivered tools or systems

3. Client Responsibilities

Clients engaging GoTech.us for services are responsible for:

  • Providing accurate, complete, and timely information about their IT environment
  • Maintaining appropriate authorization to permit GoTech.us personnel access to systems, devices, and networks as required for contracted services
  • Implementing recommended changes in a timely manner where remediation depends on client action
  • Maintaining valid software licenses for all systems GoTech.us is engaged to support
  • Retaining their own backups and records independent of any GoTech.us-managed backup solution
  • Notifying GoTech.us of changes to their environment that may affect service delivery

4. Log Data & Retention

30-Day Log Retention Limit

Log data uploaded to or processed by GoTech.us systems — including firewall logs, network event logs, endpoint telemetry, and syslog data — is retained for a maximum of 30 calendar days from the date of ingestion. After this period, logs are permanently deleted from GoTech.us infrastructure. Clients are solely responsible for maintaining their own local or archival copies of log data required for compliance, forensic, or historical investigation purposes.

Client responsibility for local log retention:

GoTech.us operates as a real-time monitoring and response service. The 30-day window is intended to support active incident investigation and threat correlation. It is not a substitute for a dedicated Security Information and Event Management (SIEM) platform or a long-term log archive. Clients with compliance obligations (PCI-DSS, HIPAA, CMMC, SOC 2, etc.) that require extended log retention must maintain their own log infrastructure. GoTech.us can advise on appropriate on-premises or self-hosted solutions upon request.

Specifically, clients should retain locally:

  • Raw firewall and network logs from all managed appliances
  • Endpoint detection and response (EDR) telemetry
  • Authentication and access logs (Active Directory, RADIUS, VPN)
  • Any logs required by applicable regulatory frameworks

GoTech.us is not liable for any regulatory penalty, compliance gap, or forensic inability resulting from a client's failure to maintain adequate local log retention.

5. Security Services & Scope of Work

Penetration testing, vulnerability assessments, and security audits are performed exclusively within the scope explicitly defined and authorized in a signed Statement of Work (SOW). All security engagements require written authorization from an authorized representative of the client organization prior to commencement of any testing activity.

GoTech.us personnel will not perform or facilitate unauthorized access to any system, even at the verbal request of a client representative. Scope expansions must be documented in writing before additional testing is conducted. GoTech.us is not responsible for findings or impacts arising from client-initiated out-of-scope actions.

Deliverables from security assessments (reports, findings, remediation guidance) are confidential and intended solely for the client's internal use. Clients must not disclose assessment findings to unauthorized parties in a manner that could expose vulnerabilities to threat actors.

6. Confidentiality

Both parties acknowledge that, during a service engagement, each may be exposed to confidential information belonging to the other, including but not limited to network topology, credentials, security configurations, business processes, and proprietary technology. Both parties agree to hold such information in strict confidence and not to disclose it to unauthorized third parties during or after the engagement.

GoTech.us personnel are bound by confidentiality obligations. Any subcontractors used in service delivery are similarly bound. Client data accessed in the course of service delivery is used solely for the purpose of delivering contracted services.

7. Intellectual Property

All content on this website — including text, graphics, logos, design elements, and code — is the intellectual property of GoTech.us or its licensors and is protected by applicable copyright and intellectual property law. Reproduction, distribution, or modification of this content without express written consent is prohibited.

Custom software, scripts, automation tools, and documentation produced by GoTech.us under a service engagement remain the property of GoTech.us unless otherwise agreed in writing in the applicable Service Agreement or Statement of Work. Clients are granted a license to use deliverables within the scope defined therein.

8. Third-Party Trademark Disclaimer

GoTech.us provides services involving a wide range of third-party hardware, software, and security platforms. References to any brand, product, or company name on this website are for identification and informational purposes only and do not imply any affiliation with, endorsement by, or sponsorship from those companies.

GoTech.us is an independent service provider and is not an authorized reseller, certified partner, or franchisee of any vendor unless explicitly stated otherwise in a current, valid partnership agreement with that vendor.

9. Disclaimer of Warranties

This website and the information contained herein are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

GoTech.us does not warrant that: (a) the website will be uninterrupted or error-free; (b) defects will be corrected; (c) the website or servers that make it available are free of viruses or other harmful components. Cybersecurity services reduce risk but cannot guarantee the prevention of all security incidents. No security solution, including those provided by GoTech.us, can provide absolute protection against all possible threats.

10. Limitation of Liability

To the maximum extent permitted by applicable law, GoTech.us and its officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of revenue, loss of data, business interruption, or reputational harm — even if GoTech.us has been advised of the possibility of such damages.

GoTech.us's total aggregate liability arising out of or related to any service engagement shall not exceed the total fees paid by the client to GoTech.us in the three (3) months immediately preceding the event giving rise to the claim.

This limitation does not apply to liability arising from GoTech.us's gross negligence or willful misconduct.

11. Indemnification

You agree to indemnify, defend, and hold harmless GoTech.us and its officers, directors, employees, and contractors from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of this website or our services; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any inaccurate or incomplete information you provide to GoTech.us.

12. Term & Termination

These Terms remain in effect for as long as you use this website or engage GoTech.us for services. GoTech.us reserves the right to terminate or suspend access to its website and services, without notice or liability, for any conduct that GoTech.us determines — in its sole discretion — violates these Terms, applicable law, or is harmful to the interests of GoTech.us, its clients, or third parties.

Upon termination of a service engagement, provisions of these Terms that by their nature should survive (confidentiality, intellectual property, limitation of liability, log retention responsibility) shall continue in effect.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or a GoTech.us service engagement shall first be submitted to good-faith negotiation between the parties. If the dispute cannot be resolved informally within thirty (30) days, the parties agree to submit the matter to binding arbitration in Ada County, Idaho, under the rules of the American Arbitration Association, except where prohibited by law. Judgment on any arbitration award may be entered in any court of competent jurisdiction.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property or confidential information.

14. Changes to These Terms

GoTech.us reserves the right to update these Terms & Conditions at any time. When changes are made, the effective date at the top of this page will be revised. Material changes affecting active service clients will be communicated via email. Continued use of this website or our services following any revision constitutes acceptance of the updated Terms.
